GoBank Project Runway Rundown - Official Rules

NO PURCHASE NECESSARY.  A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. Eligibility: GoBank Project Runway Rundown (the “Sweepstakes”) is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry.  Employees of Green Dot Bank, Green Dot Corporation, Coburn Communication, Inc., Hearst Communication, Inc., Wildfire Interactive, Inc. (“Wildfire”), ePrize, Inc., and their respective parent, subsidiary and affiliate companies and agencies as well as the immediate family (spouse, parents, siblings and children and each of their respective spouses, regardless of where they reside) and household members (whether or not related) of each such employee are not eligible.  The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited.  Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Sweepstakes.  Winning the prize is contingent upon fulfilling all requirements set forth herein.

2. Sponsor: Green Dot Bank, 3465 E. Foothill Blvd., Pasadena, CA, 91107. Administrator: ePrize, Inc., One ePrize Drive, Pleasant Ridge, MI 48069.

3. Timing: The Sweepstakes begins on October 17, 2013 at 6:00 p.m. Pacific Time (“PT”) and ends on October 24, 2013 at 11:59 p.m. PT (the “Promotion Period”).  Wildfire’s computer is the official time-keeping device for the Sweepstakes.

4. How to Enter: During the Promotion Period, there are two (2) ways to enter the Sweepstakes:

a. Enter on Facebook: Watch the finale of Project Runway Season 12 on T.V. or watch the finale online for free (http://www.mylifetime.com/shows/project-runway/video/full-episodes).  Then, visit the GoBank Project Runway Rundown application on the GoBank Facebook page at https://www.facebook.com/GobankUS.  If you do not already “like” the GoBank Facebook page, you must first click on the “like” button to access the application.  Once you click on the tab, you will advance to the authorization page where you will be required to authorize Sponsor to pull your profile information and other content in order to participate in the Sweepstakes.  Complete and submit the registration form including your name, a valid email address, your date of birth, and state and country of your residency.  Then, follow the links and instructions to share your “Project Runway Rundown” or your personal thoughts of the show (herein, the “Submission”). When you submit a Submission, you automatically will receive one (1) entry into the Sweepstakes. All Submissions must be received by October 24, 2013 at 11:59 p.m. PT to be eligible.

Submission must be the original work of the entrant. Entrant must have permission from all individuals that appear in the Submission (if any) to use their name and likeness in the Submission and to grant the rights set forth herein.  If requested, entrant must be able to provide such permissions in a form acceptable to Sponsor.  Submissions may not contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or constitute copyright infringement.  Submissions must not include material that is inappropriate, indecent, obscene, hateful, or tortious, as determined by Sponsor, in its sole discretion.  

b. By Mail: To enter without providing your thoughts on the finale show, hand print your name, a valid email address, your date of birth, and state and country of your residency and the date for which you are entering on a 3” x 5” piece of paper and mail it in an envelope with proper postage to “GoBank Project Runway Rundown,” c/o GoBank, P.O. Box 1188, Monrovia, CA 91017.  You will receive one (1) entry into the Sweepstakes.  Limit: One (1) entry per envelope.  All mail-in entries must be handwritten and October 25, 2013 and received by November 1, 2013 to be eligible.  All entries become the exclusive property of Sponsor and none will be acknowledged or returned.  Proof of sending or submission will not be deemed to be proof of receipt by Sponsor.  Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, illegible, misdirected or postage-due entries, which will be disqualified.

Limit:  One (1) entry per person and per email address per day for users that enter online and up to seven (7) entries per person for users that enter via the mail-in during the Promotion Period, regardless of method of entry.  Multiple entrants are not permitted to share the same email address.  Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant’s entries and that entrant may be disqualified.  Use of any micro, script or automated system to participate, or any other means which subvert the entry process, are prohibited and will result in disqualification.  In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the entrant.  The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.  The potential winner may be required to show proof of being the authorized account holder.

This Sweepstakes is in no way sponsored, endorsed, administered by, or associated with Facebook, Inc. (“Facebook”). By entering this Sweepstakes, you understand you are providing your information to the Sponsor, and not to Facebook.

5. Grand Prize Drawing: Administrator is an independent judging organization whose decisions as to the administration and operation of the Sweepstakes and the selection of the potential winner are final and binding in all matters related to the Sweepstakes.  Administrator will randomly select the potential Grand Prize winner from all eligible entries received and combined during the Promotion Period, on or around November 4, 2013.  The potential Grand Prize winner will be notified by email.  Except where prohibited, the potential Grand Prize winner (or parent/legal guardian if potential winner is 18 years of age but still considered a minor in his/her state of residence) will be required to sign and return a Declaration of Compliance, Liability and Publicity Release (“Declaration”) which must be received by Administrator, within seven (7) days of the date notice or attempted notice is sent, in order to claim the prize.  If the potential winner cannot be contacted, fails to sign and return the Declaration within the required time period (if applicable), or the prize is returned as undeliverable, the potential winner forfeits the prize.  Receiving a prize is contingent upon compliance with these Official Rules.  In the event that the potential winner is disqualified for any reason, Sponsor will award the prize to an alternate winner by random drawing from among all remaining eligible entries.  Only three (3) alternate drawings will be held, after which the prize will remain un-awarded.  

6. Prize: ONE (1) GRAND PRIZE: A trip for winner and one (1) travel companion to New York, NY for a shopping spree with the winner of the Project Runway Season 12 (hereinafter, the “Event”).  Trip package includes round trip, coach-class air transportation for two (2) from a major U.S. airport near winner’s home to one (1) of the major airports that services the New York City, New York area (departure and arrival airports determined by Sponsor in its sole discretion); two (2) nights’ standard accommodations at a hotel determined by Sponsor in its sole discretion (single room, double occupancy); ground transportation to and from airport and hotel; and $500 spending money (for winner only) for shopping spree (awarded in the form of a check) to be used during the Event. Winner must complete the trip before June 30, 2014 or prize will be forfeited. Notwithstanding the foregoing, Sponsor will make reasonable efforts to select travel dates acceptable to winner. Trip must be booked at least twenty-one (21) days prior to departure.  Travel and accommodations are subject to availability and blackout dates.  Travel must be round trip.  Sponsor will determine airline and flight itinerary in its sole discretion.  No refund or compensation will be made in the event of the cancellation or delay of any flight.  Travel is subject to the terms and conditions set forth in this Sweepstakes, and those set forth by the Sponsor’s airline carrier of choice as detailed in the passenger ticket contract.  All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, gratuities, passenger tariffs or duties, airline fees, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner.  Unless child/legal ward of winner, travel companion must be eighteen (18) years of age or older as of the date of departure or a sibling/friend of winner with the appropriate parental permissions and releases and must travel on same itinerary and at the same time as the winner.  If winner is a minor in his/her state of residence, travel companion must be winner’s parent/legal guardian.  Travel companion (or parent/legal guardian on behalf of travel companion, as applicable) must execute liability/publicity releases prior to issuance of travel documents. Winner and travel companion are responsible for obtaining any necessary documentation (i.e. valid photo ID) prior to travel.  Travel restrictions, conditions and limitations may apply.  If winner resides within a 100-mile radius of New York City, ground transportation will be provided in lieu of air transportation and no compensation or substitution will be provided in lieu thereof„ at Sponsor’s sole discretion.  Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates.  Sponsor is not responsible if Event is delayed, postponed, cancelled or if Project Runway Season 12  winner cannot participate in the Event for any reason, in which event that portion of prize is forfeited in its entirety and no substitution will be provided except as in Sponsor’s sole discretion.  Approximate Retail Value (“ARV”): $2,500. Actual value of prize may vary based on airfare fluctuations, rates at time of booking and distance between departure and destination.  Winner will not receive difference between actual and approximate retail value.  Prize is non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute the prize (or portion thereof) for one of comparable or greater value if the designated prize should become unavailable for any reason.  Winner is responsible for all applicable federal, state and local taxes and fees associated with prize receipt and/or use. All prize details are at the sole discretion of the Sponsor. Odds of winning the Sweepstakes prize depend on the number of eligible entries received during the Promotion Period.

7. Release: By receipt of any prize, winner agrees to release and hold harmless Sponsor, Coburn Communication, Inc., Hearst Communication, Inc., Wildfire’s, Administrator, Facebook, Inc., and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of the prize (or any portion thereof), including any travel/activity related thereto.

8. Publicity: Except where prohibited, participation in the Sweepstakes constitutes winner’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

9. Use of Entries: By submitting an Submission, each entrant grants, and represents and warrants that the entrant has the rights and authority necessary to grant the Sponsor an irrevocable, non-exclusive, fully sublicensable license and right to exploit, edit, modify, and distribute the Submission and all elements of such Submission, including, without limitation, names and likenesses of any persons or locations embodied therein, in any and all media now known or hereafter devised, worldwide, in perpetuity without compensation, permission or notification to entrant or any third party.

10. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion.  In such event, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received and combined up to the date of discontinuance for the prize offered herein.  Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner.  Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek any and all available remedies from any such person to the fullest extent permitted by law.  Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

11. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of Submissions or entries; (5) late, lost, undeliverable, damaged, garbled, inaccurate, incomplete, postage-due or stolen Submissions, entries or mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize.  If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, if it is possible. No more than the stated number of prizes will be awarded.  In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

12. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan (Southern Division) or the appropriate Michigan State Court located in Oakland County, Michigan; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Michigan without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan.

A Note About Closed GoBank Accounts

We recently closed some GoBank accounts. As a result, there have been some questions from members. So, here’s the deal…

We take the security of our customers and their money seriously. When we see unusual activity on an account that looks like attempted fraud, money laundering or other types of financial abuse, we will typically close the account and block the member from getting another GoBank account. As part of this monitoring, we uncovered a small number of accounts that we needed to close. Any remaining balance on those closed accounts was returned to the member so they’re not out any money. We’re sorry that some of those former members are upset. However, our research into those accounts confirms it was the right thing to do.

The bottom line is that we owe it to our honest members to make sure that GoBank is safe and secure and remains a fun, easy and low cost way to bank.

State of the Bank – Survey Conducted by Harris Interactive
Illustrating the need for GoBank’s unique approach, a survey conducted by Harris Interactive called “The State of the Bank” was released today by GoBank.  The survey depicts an America that’s very open to a new way to bank. The survey found that almost 2/3 of Americans (64%) say they don’t fully trust big banks.  The majority of Americans don’t feel their bank is transparent (87%) or on their side (68%).   In the past 10 years, Americans see Banking as being one of the least innovative industries – only airlines and pet care were seen as less innovative.   And, only 11% of Americans say their bank frequently offers new tools or features that they use.
The survey shows traditional banking practices are fading, with 67% saying they write fewer paper checks, and 14% of 18-34 year-olds saying they’ve never written a paper check.  As an indicator of Americans’ overall willingness to break away from traditional banking, 65% of people (and 81% of 18-34 year olds) indicated they’d be open to using a bank like GoBank (when presented with a description consistent with GoBank’s features).  The full national survey results can be found here
Pricing
According to a study [3] by the Pew Charitable Trust, the average bank had 38 different fees that a customer could incur when using their checking account.  And around 90% of all checking accounts had a monthly fee.  The median monthly fee in the report was $12 unless the customer carries a sufficient minimum balance, which averaged $2,000.
While GoBank is one of the most feature-rich bank accounts on the market, its pricing is designed to be fair, simple and affordable.  As such, GoBank has no overdraft fees and no penalty fees of any kind, ever. Nor does GoBank have any minimum balance requirements.  In fact, while the average checking account may have as many as 38 different fees, GoBank has only four fees, which are:

SAN FRANCISCO, CA – January 15, 2013— GoBank, which launched today as a brand of Green Dot Corporation (NYSE: GDOT) released the results of its December 2012 “State of the Bank” survey conducted online nationwide, on its behalf, by Harris Interactive. The survey finds that a vast majority of Americans [1] do not fully trust big banks, and numerous people are surprised by fees or feel they’re simply unfair. Americans Don’t Fully Trust Big Banks
The comprehensive survey asked Americans about their current perceptions of banks. 
Nearly two-thirds (64%) say they do not fully trust big banks.  
When asked about their bank in particular, the vast majority of people (87%) do not feel their bank is transparent, and 68% do not perceive their bank as being “on their side.”
These perceptions are driven in part by Americans’ experiences with bank fees: 30% say they are sometimes surprised by unexpected bank fees, and 31% claim their bank’s fees are simply unfair.
It’s clear that some Americans are facing challenges when 40% say that dealing with their bank or finances stresses them out sometimes.
 
Banks Lack Innovation
In addition to specific perceptions about banks, people were asked to discuss their sense of innovation across several U.S. industries. When asked which industries have been the most innovative over the last 10 years, banking was one of the lowest, with only airlines and pet care viewed as less innovative. The most innovative industries identified were computers and mobile phones.  Along those lines, when asked who would build a better, more modern bank, two-thirds (66%) of checking account holders chose Silicon Valley over Wall Street. 
 
“Historically, traditional bank accounts have complex fees that favor the institutions, not their customers,” said Lewis Goodwin, CEO of Green Dot Bank (parent company of GoBank).  “We believe people are hungry for more transparency and innovative features from their bank… the kind they often get from tech companies.” 
 
Consumer Behavior is Changing
The behavior of consumers captured in the State of the Bank survey reflects a significant change in the use of traditional bank account services. For example, 67% of checking account holders said they write fewer paper checks than they used to, and 14% of 18-34 year olds, who are checking account holders, have never written a paper check in their life. It appears that bank branches are also becoming less relevant, with 79% of checking account holders claiming they do not visit bank branches often.
